ニューヨーク条約第2条（1）は、以下の契約に適用されます。
Agreements “in writing under which the parties undertake to submit to arbitration all or any differences which have arisen or may arise between them in respect of a defined legal relationship, whether contractual or not”
"契約に基づくものであるかどうかを問わず、仲裁による解決が可能である事項に関する一定の法律関係につき、当事者の間にすでに生じているか、又は生ずることのある紛争の全部又は一部を仲裁に付託することを当事者が約した書面による"合意
最後に、条約は、仲裁合意が、第二条（2）で定義された要件"書面による"ものであることを要求しています。
