第一条第（1）は次の観点で仲裁に関してニューヨーク条約の適用の管轄範囲を定義しています
“This Convention shall apply to the recognition and enforcement of arbitral awards made in the territory of a State other than the State where the recognition and enforcement of such awards are sought, and arising out of differences between persons, whether physical or legal. It shall also apply to arbitral awards not considered as domestic awards in the State where their recognition and enforcement are sought.”
この条約は、仲裁判断の承認及び執行が求められる国以外の国の領域内においてされ、かつ、自然人であると法人であるとを問わず、当事者の間の紛争から生じ た判断の承認及び執行について適用する。この条約は、また、仲裁判断の承認及び執行が求められる国において内国判断と認められない判断についても適用す る。
したがって、条約は、外国および非国内仲裁判断の承認及び執行のみを扱います。これは、国内の裁定の認識と執行には適用されません。条約は、仲裁合意につき一切の同様の規定が含まれていません。しかし、条約は "外国"または国際仲裁合意のみに適用されることが確立されている。
